1 MR. MCCARTY: Thank the Court for the

2 opportunity to pass this matter and further discuss the

3 offer.

4 We -- Mr. Sanders wishes to decline that offer

5 and reject it.

6 There's one bit of housekeeping I want to get

7 done with the prosecution before we start the selection

8 process and I don't know if that might impact things but

9 for now --

10 THE COURT: So, Mr. Sanders, you understand you

11 are still under oath?

12 DEFENDANT SANDERS: Yes.

13 THE COURT: And you had a chance to speak with

14 Mr. McCarty about the offer, and, again the -- I don't

15 want to know exactly what you talked about but you

16 understand that there is a potential for prison time if

17 the Court wanted to exceed the guidelines?

18 DEFENDANT SANDERS: Yes.

19 THE COURT: All right. And is it your decision

20 as you indicated -- as your attorney indicated to reject

21 the offer?

22 DEFENDANT SANDERS: Yes.

23 THE COURT: And, again, has anyone threatened

24 you, coerced you in any way, forced you to reject the

25 offer?
