1 I don't know, it seems rather coercive to put
2 on the record that we'll give you probation and
3 alternatively 90 days in jail, if you roll the dice and go
4 to trial, you're looking at prison.
5 MR. PENNEY: I see it the other way, is I --
6 THE COURT: No -- no. Look, I think -- I
7 always ask people whether or not they have talked to their
8 attorney, they are fully aware of all of the potential
9 consequences. I didn't do it on this exact occasion but
10 typically I ask whether or not the guidelines have been
11 scored.
12 These are to -- what are the maximum on these?
13 MR. PENNEY: Five years -- I think I had them
14 scored at -- I can't remember if he's the two to nine or
15 the zero to nine on an intermediate cell. I can't recall
16 off the top of my head.
17 THE COURT: I mean, I think it's important to
18 recognize -- let's see. We've got some guidelines scored
19 back from December of 2020. They appear to be 5 to 23.
20 Again, those are old.
21 MR. PENNEY: Yeah, I can't recall.
22 MR. MCCARTY: Counts One and Two are four
23 years, for what it is worth.
24 THE COURT: So, I mean, I guess, it's
25 important -- look, the guidelines are the guidelines.
